Gunn Land offers consulting, curative title, and the review of in-house contracts to nonoperators on an hourly-rate basis.  For nonoperators, it is crucial to understand the custom terms of Operating Agreements (JOAs) and other contracts that define the relationship between nonoperators and operators in oil and gas exploration. 


Gunn Land also reviews incoming authorizations for expenditures (“AFEs”) and discerns the notice clocks attendant to them. These services allow nonoperators to guard their interests in existing and proposed wells. Gunn Land is available to perform title research and inspect transactional documents being used, such as purchase sale agreements. Acquisition companies are advised to also obtain the secondary review of a law firm in their endeavors to properly identify title and contractual issues.  Important contractual terms to be aware of are title diligence deadlines, notice clocks, and how title defects are quantified under the governing contract.  Buyers should also discern what level of title product the seller can provide before signing a purchase sale agreement.

Gunn Land assists landowners in understanding their ownership in light of available title documents and public data. The Company can also review oil and gas lease offers by inspecting the bonus amount, royalty rate, and offered terms. Clients frequently benefit from having instruments procured that substantiate their interests in the county records, such as probates, affidavits of heirship, and affidavits of identity. While oil and gas operators normally are the only parties possessing the resources to obtain a full title picture, Gunn Land regularly uses: i) county records; ii) Texas Railroad Commission data; and iii) General Land Office information to provide landowners with a fuller picture of their situations.
